Is this company liable for my bank overdraft fees?

A certain large company mistakenly charged me for something and promised to credit it back, yet before that promised credit posted, FOUR overdraft fees were essed to my account. Is the company liable for this at all (my bank says they're not responsible, so they can't help me.)?
